Storage Unit Lease Holder fined $3,000 for Waste Violations

Description of Offence -  The conviction relates to permitting a site to be used for the disposal of hazardous waste at a location that is not a ministry approved waste disposal site.

Date of Offence - During the period beginning on or about June 8, 2017and ending on or about July 19, 2017.

Date of Conviction - March 21, 2019

Penalty Imposed - Thai Duy Bui was convicted of one violation under the Environmental Protection Act and was fined $3,000 plus a victim fine surcharge of $750 with 12 months to pay the fine.

Background:  

  • Thai Duy Buiis an individual who leased a public storage unit from 2014 through 2017, which was located on Ellesmere Road in Toronto.
  • Mr. Bui stopped making storage unit rental payments in 2017 and abandoned the contents of the storage unit, which were then sold via an online auction.
  • The contents subsequently had to be identified so that the buyer could arrange for disposal. It was identified as a combination of liquid and solid wastes, characterized as corrosive, ignitable and reactive.
  • The ministry's Investigations and Enforcement Branch investigated and laid one charge which resulted in one conviction.
