Greenhouse fined $10,000 for Ontario Water Resources Act Violation

Penalty Imposed - Via Verde Hydroponics was convicted on one violation under the Ontario Water Resources Act and was fined $10,000 plus a victim fine surcharge of $2,500 and was given 1 year to pay the fine.
- Via Verde Hydroponics Ltd. operates a large greenhouse in Leamington, and operates a sewage works for the collection, transmission, treatment and disposal of their stormwaters, under ministry approval.
- On November 7, 2016, ministry staff inspected the greenhouse and took water samples from where the facility stormwater pond outfalls to the Campbell Drain (municipal drain), which were then sent for testing/analysis.
- Lab results indicated that the stormwater discharge contained phosphorous levels almost 75 times greater than the objective of 0.50 mg/I phosphorus listed on the ministry approval for the stormwater management facility.
- An investigation resulted in one charge being laid and evenutally one conviction.
